Booking conditions
Article 1 – Purpose
These General Terms and Conditions govern short-term rental contracts for leisure accommodation concluded between Kabana Village and any person booking a stay as a holiday guest. The rental is granted for a fixed period and exclusively for tourism purposes. It may not constitute a primary or secondary residence nor be used for administrative or professional domiciliation.
Article 2 – Booking
The booking becomes firm and final upon receipt either of a 30% deposit of the total stay amount or of full payment when the booking is made less than 30 days before arrival. The balance must be paid no later than 30 days before arrival. Failing payment within this period, Kabana Village may cancel the booking as of right.
Article 3 – Acceptance of the GTC and Internal Regulations
These General Terms and Conditions and the Internal Regulations of Kabana Village are provided to the Client prior to booking confirmation. Payment of the deposit or balance constitutes full and unconditional acceptance of these GTC and the Internal Regulations.
Article 4 – Prices – Tourist tax
Prices are expressed in euros, all taxes included. They include the provision of the accommodation. Access to collective facilities is provided in accordance with the Internal Regulations, in particular depending on opening periods and safety or maintenance requirements.
Article 5 – No right of withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to accommodation services provided for a specific date.
Article 6 – Arrival – Departure
Arrival: from 4:00 PM. Departure: before 10:00 AM. Any unauthorized late departure may result in additional charges.
Article 7 – Occupancy
The accommodation may only be occupied by the persons declared at the time of booking. The maximum capacity is eight (8) persons, including children and infants.
Article 8 – Security deposit
A security deposit of €300 is required upon arrival. It may be retained in whole or in part in the event of damage or non-compliance with the premises or the Internal Regulations.
Article 9 – Insurance
The Client must be covered by holiday civil liability insurance for the entire duration of the stay.
Article 10 – Cancellation by the Client
More than 30 days before arrival: refund of sums paid, less €25. Between 30 and 7 days: the deposit is retained. Less than 7 days before arrival: the entire stay is due.
Article 11 – Swimming pool and collective facilities
Swimming facilities are not supervised. Bathing is at the users’ own risk.
Article 12 – Pets
Only dogs and cats are permitted, limited to two (2) animals per accommodation.
Article 13 – Conduct and exclusion
Any behaviour likely to disturb the peace or safety of occupants may result in immediate termination of the stay without refund.
Article 14 – Liability
Kabana Village shall not be held liable for theft or loss of personal belongings.
Article 15 – Interruption of services
Kabana Village shall not be held liable for the temporary unavailability of certain collective facilities for technical or safety reasons.
Article 16 – Personal data
Data collected are necessary for reservation management and are processed in accordance with GDPR.
Article 17 – Mediation
In the event of a dispute, the Client may resort free of charge to a mediation procedure: Atlantique Médiation – Nantes.
Article 18 – Applicable law and jurisdiction
These GTC are governed by French law.
Interpretation
In the event of any discrepancy or difficulty of interpretation between the different language versions, the French version shall prevail.
