PREAMBLE

At Chadotel, we make the success of your holiday our personal concern. These General Terms and Conditions of Sale (the “Terms and Conditions”) set out the rules governing bookings, payments, cancellations and stays at our campsites. They comply with the legislation in force, including the French Tourism Code, the French Consumer Code and the collective agreement for the outdoor accommodation industry. By booking with us, you fully accept these Terms and Conditions as well as the internal regulations of your Chadotel campsite.

Order, booking or rental: this simply refers to the purchase of your stay and our services.

Our services:

Pitches, with or without private sanitary facilities

Lodges

Mobile leisure homes

Lightweight leisure dwellings

Villas and holiday cottages

Maximum sleeping capacity: each accommodation unit or pitch has a maximum permitted number of occupants.

For accommodation units, this number is indicated when booking online or can be checked in the description available at reception.

For bare pitches, the maximum is 6 people, including babies.

ARTICLE 1 – SCOPE OF APPLICATION

These Terms and Conditions apply, without restriction or reservation, to any booking of accommodation or a bare pitch at any campsite operated by SAS CHADOTEL, 54 Rue Georges Clemenceau, 85520 Jard-sur-Mer, France, registered with the La Roche-sur-Yon Trade and Companies Register under SIREN No. 38833452600083.

They apply to both private and business customers booking:

on our website: chadotel.com;

by telephone;

by post;

by email.

The main characteristics of our services (accommodation, pitches and facilities) are presented:

directly on our website; or

if you book by another method, in a written medium (paper or electronic).

Customers must therefore read this information before confirming their booking. Choosing and purchasing a stay is their responsibility.

These Terms and Conditions replace all other terms applicable at Chadotel, particularly those relating to other sales channels. They are available at any time on our website, and the version in force at the time of booking shall apply.

Unless proven otherwise, the data recorded in our computer system constitutes evidence of all transactions concluded with the Customer.

Personal data protection

In accordance with the French Data Protection Act (“Informatique et Libertés”) and the European General Data Protection Regulation, the Customer may at any time exercise their rights of access, rectification or objection (where processing is not necessary for the performance of the contract).

To do so, the Customer must write, providing proof of identity, to:

Acceptance of the Terms and Conditions

By booking a stay with us, the Customer declares that they have read and accepted these Terms and Conditions:

by ticking the box provided when booking online; or

by any other appropriate means for all other booking methods.

ARTICLE 2 – BOOKINGS

Booking your stay with Chadotel is simple. You select, online or using the documents provided by Chadotel:

your chosen campsite;

the available dates;

the type of stay;

the options you want, and then confirm your order.

You are responsible for checking that all the information in your order is correct and must notify Chadotel within 24 hours if you find an error.

The booking becomes final only once Chadotel has sent written confirmation (by email or post). Any order confirmed on www.chadotel.com therefore constitutes a distance contract between you and Chadotel.

Please note:

Minimum stay:

  - Low season (outside school holidays): at least 2 nights.

  - Public-holiday weekends and major events: at least 3 to 4 nights.

  - High season (school holidays): rentals require a minimum stay of 7 nights, with arrivals on Saturday, Sunday or Wednesday depending on the campsite.

Bookings are made in the named Customer’s name and may not be transferred under any circumstances.

Legal capacity

By accepting these Terms and Conditions and confirming their booking, the Customer declares that they have the legal capacity required to enter into a contract. If they do not, authorisation from a guardian or legal representative is required.

Individual and group bookings

The accommodation and pitches offered online are intended exclusively for individual customers. For group bookings, please contact our Reservations Department directly by email or through the “Contact” section of the website. Chadotel reserves the right to accept or refuse the request after reviewing it.

Participants

Every participant counts, regardless of age.

One baby = one child = one adult = one participant.

Bare pitches

When booking a bare pitch, the Customer must provide the exact dimensions of their vehicle (caravan, motorhome or trailer). Any error may make it impossible to use the pitch, and the consequences will remain the Customer’s responsibility.

ARTICLE 3 – PRICES

Chadotel stays are offered at the prices in force when the booking is made, as shown:

on our website, chadotel.com; or

in any Chadotel information or communication material.

Our prices are stated in euros, excluding and including taxes.

Discounts and special offers

Our prices take account of any special offers or discounts advertised on our website or in our communication materials.

Price validity

Prices are fixed and may not be revised during their validity period (as stated on the website, in a confirmation email or in a written offer sent to the Customer).

Once this period has expired, the offer is no longer valid and Chadotel is no longer bound by the prices quoted.

Administrative and handling fees

Displayed prices do not include processing and administration fees, which are added to the price of the stay.

These fees are specified on our website or in the information sent before booking. They are calculated and added to the total amount when the order is placed.

Amount payable

The amount payable by the Customer is therefore the total booking price, including fees. Chadotel will issue an invoice and provide it to the Customer at the end of the stay.

3.1. Tourist tax

The tourist tax, collected on behalf of the municipality or local authority, is not included in our prices.

The amount varies depending on the destination and is calculated per person aged over 18, per day.

The rate in force during the stay applies, not the rate in force on the booking date.

It is paid at the same time as the stay and is clearly shown on the invoice.

3.2. Choice of a specific pitch or location

Selecting a specific pitch is subject to availability and incurs an additional fee of €30 for a bare pitch, or €30 in low season / €50 in high season for a rental accommodation unit.

The applicable period is determined by the first day of the stay:

High season: 3 July 2027 to 29 August 2027 inclusive.

Low season: outside this period.

ARTICLE 4 – PAYMENT TERMS

4.1. Booking deposit

If you book more than one month before arrival:

For both rental accommodation and pitches, the booking deposit is 30% of the total cost of the stay, plus:

booking fees:

  - €8 for a stay of fewer than 3 nights;

  - €25 for a stay of 4 nights or more, or €15 if you book directly on chadotel.com;

cancellation insurance, if you wish to take it out (optional).

This initial payment is deducted from the total cost of the stay but will not be refunded in the event of cancellation.

The balance must be paid:

30 days before arrival for rental accommodation;

on the day of arrival for a pitch.

If you book less than one month before arrival, the full amount for a rental stay is payable immediately.

4.2. Confirmation of payments

Your payment is considered final only once Chadotel has actually received the funds.

4.3. Failure to comply with payment terms

If payment is not made by the due date, Chadotel may:

suspend or cancel your booking; and/or

suspend its obligations after a formal notice has been issued and remains unheeded.

4.4. Accepted payment methods

Chadotel offers several simple and secure payment methods:

Bank card

On chadotel.com;

via the link received by email when your booking option is confirmed; or

by telephone through the Reservations Department.

A confirmation email will be sent once the payment has been validated.

Bank transfer

The bank details are shown at the bottom of your booking confirmation or pro forma invoice, attached to the email confirming your booking option.

Confirmation will be sent by email once the transfer has been received.

Cheque

The cheque must be made payable to the campsite booked.

Accepted up to 15 days before the start of the stay, provided it is received before the booking option expires.

Confirmation will be sent by email upon receipt.

ANCV paper holiday vouchers

Send by registered post with acknowledgement of receipt to the same address.

Accepted up to 15 days before arrival, provided they are received before the booking option expires.

Confirmation will be sent by email upon receipt.

Chèques-Vacances Connect

Directly online when booking; or

by telephone for the balance only, using the ANCV mobile app.

You choose the amount; an additional bank-card payment may be required.

Cadhoc and Bimpli vouchers

Send by registered post with acknowledgement of receipt to the same address.

Accepted up to 15 days before arrival, provided they are received before the booking option expires.

Confirmation will be sent by email upon receipt.

ARTICLE 5 – PROVISION OF SERVICES

5.1. Availability and use of services

Accommodation

Arrival: from 4 p.m.

Departure: before 10 a.m.

Balance: payable 30 days before arrival; otherwise, the booking may be cancelled.

Bare pitches (motorhomes, caravans, tents)

Arrival: from 12 noon, depending on reception opening hours in low season.

Departure: before 12 noon.

Balance: payable on the day of arrival.

Pitches with private sanitary facilities (motorhomes, caravans, tents)

Arrival: from 2 p.m., depending on reception opening hours in low season.

Departure: before 11 a.m.

Balance: payable on the day of arrival.

Each accommodation unit or pitch is intended for a specific number of people and one vehicle only.

No additional accommodation (tent, caravan or other) may be set up on the pitch or alongside the accommodation.

Accommodation units and pitches must be returned in the same state of cleanliness as on arrival.

If cleaning has not been carried out, a cleaning fee (as stated on the Chadotel website) will be charged.

Any damage will be repaired immediately at the Customer’s expense.

The final inspection of the rental accommodation must match the initial inventory.

A wristband will be issued to each registered occupant to access the swimming pool and campsite facilities, depending on the period.

Wearing the wristband is compulsory. Lending it to another person is strictly prohibited. Access may be refused to anyone without a wristband.

Charging electric vehicles

For safety reasons, electric vehicles must not be plugged directly into the electrical supply of a mobile home.

Suitable charging stations are available at the campsite. This is a paid service, charged at the current rate.

5.2. Security deposit

For rental accommodation, a security deposit of €250 to €400 is required by bank-card pre-authorisation through the customer area two days before arrival (mandatory for any late arrival without going through reception), or at the latest on the day of arrival, in exchange for the keys.

The deposit is released within 72 hours after the rental inspection, less any costs incurred for repairs or restoring the accommodation, where applicable.

ARTICLE 6 – LATE ARRIVAL, INTERRUPTION OR CANCELLATION OF A STAY BY THE CUSTOMER

Certain rules apply if your plans change.

No discount or refund will be granted in the event of:

late arrival;

early departure; or

a partial or total change in the number of participants.

6.1. Amendments

Any request to amend a booking must be made in writing and is subject to Chadotel’s approval and availability.

Amendments may concern the dates, accommodation or number of people. Any increase in the price of the stay must be paid by the Customer.

Any reduction in the length of stay is considered a partial cancellation and is subject to the conditions set out in Article 6.3.

If the dates are changed, the prices and commercial terms in force on the date of the amendment will apply. An expired one-off promotional offer cannot be retained. A new booking contract will then be issued.

6.2. Interruption of the stay

Early departure does not entitle the Customer to a refund.

6.3. Cancellation

Any cancellation must be notified in writing to the Reservations Department at info@chadotel.com.

6.3.1. Without cancellation insurance

Chadotel will not issue any refund, except for bookings made under the Flex Rate, in accordance with Article 6.4.

6.3.2. With cancellation and stay-interruption insurance

This insurance must be purchased when the initial booking is made, through our partner Gritchen Affinity – “Campez Couvert”.

The Customer must refer to the insurer’s general terms and conditions and confirms that they have read the insurance terms at the time of purchase.

The claim must be reported within 10 working days of the event (within 2 working days in the event of theft).

In the event of cancellation, two options are available:

With supporting documents: reimbursement of 100% of the amount paid, excluding booking fees, the insurance premium and subject to the insurer’s other terms and conditions.

Without supporting documents: reimbursement of 70% of the amount paid, excluding booking fees and the insurance premium.

If the stay is interrupted, the unused portion will be calculated pro rata temporis based on the booked stay.

6.4. Cancellation under the Flex Rate

The Flex Rate is a specific pricing option available exclusively for bookings made on chadotel.com. This rate is higher than the standard rate and allows the Customer to benefit from the amendment and cancellation conditions set out in this article.

6.4.1. Changes to a booking

Any booking made under the Flex Rate may be amended without amendment fees, subject to availability at Chadotel. Changes may include the dates of the stay and/or the category of accommodation booked.

Any amendment resulting in an increase in the price of the stay requires payment of the corresponding difference. If an amendment reduces the price of the stay, the conditions applicable to the Flex Rate remain unchanged.

6.4.2. Cancellation of a booking

A Customer who has booked under the Flex Rate may cancel their booking up to 45 calendar days before the scheduled arrival date without having to give a reason.

If cancellation takes place within this period, Chadotel will refund 100% of the amounts paid for the stay, excluding:

booking or administration fees;

any cancellation-insurance premium paid.

The cancellation must be submitted in writing to Chadotel before the 45-day deadline preceding the arrival date. The date on which Chadotel receives the cancellation request shall be taken as the reference date.

6.4.3. Cancellation less than 45 days before arrival

Cancellations made less than 45 days before the scheduled arrival date are not covered by the Flex Rate cancellation conditions. The standard cancellation conditions applicable to the booking will then apply, without prejudice to any cover provided by cancellation insurance purchased by the Customer.

The Flex Rate is not insurance and must not be treated as cancellation-insurance cover. It is independent of any cancellation-insurance policy the Customer may have purchased.

6.5. No-show

If the Customer does not arrive on the scheduled arrival date and has not informed the campsite in advance:

the booked accommodation or pitch will be held for 24 hours;

after this period, the booking will automatically be considered cancelled;

Chadotel may then re-let the accommodation or pitch;

all sums already paid (deposit, balance, booking fees and insurance) will be retained by Chadotel and no refund may be claimed.

ARTICLE 7 – CUSTOMER OBLIGATIONS

7.1. Public liability insurance

Every Customer staying in Chadotel accommodation or on a Chadotel pitch must be covered by public liability insurance.

Proof of insurance may be requested before the start of the stay.

Minors may not stay alone and must be accompanied by a parent or legal guardian.

7.2. Pets

At Chadotel, your four-legged companions are welcome, subject to a limit of one animal per pitch or accommodation unit, depending on the type of rental.

The following rules must be observed:

Pets remain their owners’ responsibility.

The following are prohibited:

  - new pets/“new companion animals” (NAC);

  - dangerous animals, particularly category 1 and 2 dogs under Articles L.211-11 and L.211-12 of the French Rural Code.

Pets must be declared at the time of booking.

Pets must be kept on a lead at all times within the campsite. They are not allowed in communal buildings, swimming-pool areas or playgrounds.

Pets must never be left alone in accommodation, even temporarily.

Owners must collect their pets’ droppings and dispose of them in the bins provided.

Pets must be vaccinated and their vaccination records must be up to date.

Specific Chadotel pet fees apply, as indicated at the time of booking.

7.3. Barbecues

Electric barbecues and planchas are prohibited at all Chadotel campsites, except at Les Îles campsite. Gas or charcoal barbecues are permitted and may be available to rent on site, depending on the campsite. Charcoal barbecues are subject to local prefectural authorisation.

7.4. Visitors

Visitors are admitted under the responsibility of the camper they are visiting, only with the campsite manager’s authorisation and payment of any applicable supplement. Visitors may use the facilities and services except for the aquatic areas. Vehicles must be parked in the car park outside the campsite.

7.5. Internal regulations

The campsite’s internal regulations are displayed at the entrance and reception.

Customers must read and comply with them. A copy may be provided on request.

If the regulations are not complied with, Chadotel reserves the right to terminate the accommodation contract and immediately remove the Customer and/or other occupants from the campsite, without refunding any amounts already paid.

ARTICLE 8 – LIMITATION OF THE SERVICE PROVIDER’S LIABILITY

8.1. Vegetation and parking

Chadotel cannot be held liable for material damage caused by falling small branches or pine cones, particularly damage to Customers’ vehicles.

Even where trees are professionally and regularly pruned, this natural risk may remain on pitches where vehicles are parked near accommodation.

The Customer acknowledges being informed of this risk and agrees to take precautions (for example, using a protective cover).

To avoid this risk entirely, the Customer may park their vehicle:

in the car park at the entrance to the campsite; or

in designated parking spaces on the public road.

8.2. Swimming pools, pools and bathing

In accordance with the opinion of the French Council of State (Interior Section, No. 353 358 of 26 January 1993), swimming pools and bathing areas are not required to be supervised.

Swimming is therefore entirely at users’ own risk. Parents must supervise their minor children at all times. Any accident or drowning shall be the responsibility of the user and/or their parents.

Chadotel shall under no circumstances be held liable.

Only the following swimwear is permitted in swimming pools: one-piece swimsuits, bikinis, swimming briefs and swimming boxer shorts.

UV-protective T-shirts are permitted for children up to the age of 6. Above that age, a medical certificate must be provided.

ARTICLE 9 – RIGHT OF WITHDRAWAL

In accordance with Article L.221-28 of the French Consumer Code, services relating to the organisation and sale of stays or excursions for a specific date or period are not subject to the statutory withdrawal period applicable to distance and off-premises contracts.

ARTICLE 10 – PERSONAL DATA PROTECTION

10.1. Legal basis for processing

Chadotel processes personal data on the following legal bases:

Chadotel’s legitimate interests, in particular for:

  - marketing and prospecting;

  - managing relationships with customers and prospective customers;

  - organising Chadotel events, registrations and invitations;

  - processing, performing, managing and monitoring customer requests and files;

  - preparing documents on behalf of its customers.

Compliance with legal and regulatory obligations, in particular regarding:

  - prevention of money laundering and terrorist financing;

  - anti-corruption measures;

  - invoicing;

  - accounting.

10.2. Data retention periods

Customers: data is retained for the duration of the contractual relationship, plus 3 years for customer engagement and marketing purposes, unless longer retention periods are required by law.

Prevention of money laundering and terrorist financing: 5 years after the end of the relationship with Chadotel.

Accounting: 10 years from the end of the relevant financial year.

Prospective customers: data is retained for 3 years if they have not participated in or registered for a Chadotel event.

10.3. Recipients

Processed data is intended solely for authorised persons within Chadotel.

10.4. Rights of data subjects

In accordance with the French Data Protection Act and Regulation (EU) 2016/679 (GDPR), individuals have the following rights regarding their personal data:

the right of access, rectification, enquiry, restriction, portability and erasure;

the right to object at any time to processing based on legitimate interests;

the right to object to direct marketing;

the right to set general or specific instructions concerning what happens to their data after their death.

These rights may be exercised:

Data subjects also have the right to lodge a complaint with the CNIL (French Data Protection Authority).

10.5. Image rights

The Customer authorises Chadotel to use photographs taken during the stay that show the Customer, their children or accompanying persons, for communication purposes relating to the campsites and the Chadotel group, without compensation and without limitation on use.

If the Customer does not wish to authorise such use, please complete the statement below and return it to: Chadotel – 54 Rue Georges Clemenceau – 85520 Jard-sur-Mer, France.

I, the undersigned: ………………………………………………………, do not authorise the campsite to reproduce, publish, distribute or use my image, or the image of any other participant covered by this contract, for advertising purposes, on any medium whatsoever.

ARTICLE 11 – INTELLECTUAL PROPERTY

The content of www.chadotel.com belongs to Chadotel and its partners and is protected by French and international intellectual property laws.

Any reproduction, distribution or use, in whole or in part, is strictly prohibited and may constitute an infringement offence.

Chadotel also retains all rights relating to photographs, presentations, studies, drawings, designs, prototypes, etc., produced—even at the Customer’s request—in connection with the provision of the Services.

The Customer may not reproduce or use these items without Chadotel’s prior written authorisation. Chadotel may require financial compensation.

The same applies to names, logos, graphic representations and texts belonging to or used by Chadotel.

ARTICLE 12 – GOVERNING LAW – LANGUAGE

These Terms and Conditions and all transactions arising from them are governed by French law.

They are written in French. In the event of a translation into one or more foreign languages, the French version shall prevail in the event of a dispute.

ARTICLE 13 – DISPUTES

Any dispute relating to the validity, interpretation, performance or termination of these Terms and Conditions that cannot be resolved amicably between Chadotel and the Customer shall be referred to the competent courts under ordinary law.

If no amicable agreement can be reached, consumers may refer the matter free of charge to the consumer mediator responsible for the professional, namely AVENIR CONSO, within one year of sending a written complaint to the professional.

ARTICLE 14 – PRE-CONTRACTUAL INFORMATION – CUSTOMER ACCEPTANCE

The Customer acknowledges that, before placing an order, they received these Terms and Conditions and all information required under Articles L.111-1 to L.111-7 of the French Consumer Code and the Order of 22 October 2008 concerning the prior information to be provided to consumers about rental accommodation in the outdoor hospitality sector, in a clear and understandable form.

This information includes, in particular:

the essential characteristics of the Services, depending on the medium used and the type of service booked;

the price of the Services and any additional fees;

information about Chadotel’s identity, postal, telephone and email contact details, and activities, where these are not obvious from the context;

information about legal and contractual guarantees and how they may be implemented and, where applicable, about the functionality and interoperability of digital content;

the possibility of using mediation in the event of a dispute;

information about termination procedures and other important contractual conditions.

Placing an order on chadotel.com by an individual or legal entity implies full adherence to and acceptance of these Terms and Conditions.

The Customer expressly acknowledges this acceptance and waives the right to rely on any conflicting document that cannot be enforced against Chadotel.
