TERMS OF SALES

1) Booking conditions:
- The reservation becomes effective only with the agreement of the Village after receipt of the payment of the deposit and after receipt of the estimate duly completed and signed and after acceptance of the general conditions of sale.
- Reservations only bind the Village of Cottages if the Village of Cottages has accepted them, which the Village of Cottages is free to do or refuse depending on availability, and in general, on all circumstances of nature interfere with the execution of the reservation made. The Village of Cottages offers family-oriented stays, in the traditional sense, the accommodations are specially designed for this purpose. The Village of Cottages reserves the right to refuse any reservation which would be contrary to this principle, or which would seek to circumvent it.
Any payment by the customer for the reservation implies acceptance of the General Conditions of Sale and the Internal Rules.
- The rental of accommodation is made on a strictly personal basis. Under no circumstances may you sublet or transfer your reservation without the prior consent of the village.
- Minors must be accompanied by their parents or legal representative.
- Lease :
 The rental accommodations are equipped. The basic package is 2 to 8 places depending on the type of rental.
 The Village reserves the right to refuse access to the village to groups or families arriving with a number of participants greater than the capacity of the rented accommodation.
- Booking fees: The administrative fees are €3 per stay for all bookings with the exception of special rates (partners, groups).
- Group booking:
 Any reservation of more than 5 accommodations by the same natural person or by different natural persons who know each other and travel together for the same reasons on the same dates of stay at the Village of Cottages, is considered as a group.
 The accommodation offered on the merchant website of the Pôle du Cheval et de l'Âne, section Village de Cottages is intended for individual customers.
 For any group reservation request, you must contact the Village de Cottages by telephone, e-mail or via the “Contact us” section of the “polechevaletane.fr” website. The Village of Cottages reserves the right to study the reservation request before accepting or refusing it.
- The Village of Cottages reserves the right:
a) To refuse reservations for a single night during school holiday periods, weekends of entertainment or public holidays and other dates that require it;
b) Or to limit the number when these are requested more than 30 days before the start of the stay.

- Accommodation is randomly assigned based on remaining availability. If the customer indicates a wish when booking, the Cottage Village will do its best to satisfy it within the limits of its availability, but this additional service does not constitute a contractual guarantee. The non-satisfaction of the latter can in no way be a reason for cancellation or a pretext for any request for reimbursement or compensation.

2) Rates and tourist taxes:

- The rates are applicable for the 2022 season and include VAT. The latter appearing on the brochures or on the Internet are communicated subject to error or omission. The contractual price is the one fixed at the time of confirmation of the reservation.

- The prices are inclusive of all taxes and include the rental of the accommodation and its equipment, the charges (water, electricity, heating), the bed linen (the beds are made on arrival), the bathroom linen and access to free leisure activities.

- On the other hand, the prices do not include the final cleaning (the cottage must be returned in a perfect state of cleanliness, subject to a flat rate billing of 30 to 67 € depending on the type of cottage as indicated in paragraph 6. C “), personal consumption, additional sales, access to paid leisure activities, deposit and tourist tax.
- The tourist tax, which is collected both on behalf of the municipality and the department, is to be paid on site. The amount of this is calculated according to the amount of the stay and is limited to €1.10 per night and per adult. Nevertheless, the amount of the tourist tax is given as an indication and may be subject to variations linked to the decisions of the Municipal Council of the commune and the General Council of Cher.

3) Terms of payment:
- For reservations made more than 30 days before the start of the stay, a deposit of 30% of the price of the amount of the services reserved must be paid upon reservation at the Village de Cottages. The balance must be paid no later than 7 days before the start date of the stay at the Village de Cottages. In the event of non-payment of the balance by the customer at the latest 7 days before the start of the stay, the Village of Cottages reserves the right to cancel the reservation and to offer the accommodation for rent again. The sums paid are then not refunded.
- For bookings made less than 7 days before the start date of the stay at the Village of Cottages, full payment must be made at the time of booking (30% deposit + balance of the stay).
- Means of payment accepted:
a) Check (made out to SPL Les Mille Lieux du Berry at the following address: Pôle du Cheval et de l'Âne, Domaine des Amourettes, 18160 La Celle-Condé)
b) Holiday voucher (at the address above)
c) Cash
d) Or by credit card via the link sent when booking
e) Transfer.
The Village of Cottages reserves the right to refuse payment by bank check and by holiday voucher if there is not enough time, between the time of booking and the start of the stay, to receive and cash them.
- In the context of a reservation with a gift voucher, a gift box or a gift voucher from the Village of Cottages, or from one of our partners, you will be asked for the number of the latter in order to confirm it. The gift voucher, gift box or gift voucher valid on the date of the stay will be requested upon arrival. Without presentation of the latter, you will be invoiced on site for the amount of the stay with the services included at the current rates.

4) Absence and right of withdrawal:
- In accordance with Article L221-28 of the Consumer Code, the Village de Cottages informs its customers that the sale of accommodation services provided on a specific date or according to a specific periodicity is not subject to the provisions relating to 14 day cooling-off period.

5) Cancellation and modification:
Modification of the reservation
- The customer can request the modification of his stay on written request to the Village of Cottages (mail or email), subject to availability on the new dates desired in the same year. No postponement will be accepted for the following season. Failing any modification, the customer must make his stay under the initial booking conditions or cancel it according to the general conditions of sale.
- Any request to increase the length of stay will be made according to availability and according to the rates in force.
- Any request to reduce the duration of the stay is considered as a partial cancellation and will be subject to the terms of cancellation and interruption of stay.

Services not used
In the event of a stay being interrupted or shortened for one of the following reasons:

• Closure of borders by administrative decision
• Administrative closure of the Village

Limitation of travel to a number of kilometers by administrative decision not allowing you to come to the Village of Cottages
A voucher for an amount corresponding to the unused nights, valid for two years, will be issued by the campsite. In the event of refusal by the customer of this voucher, he will be reimbursed, on request, for the corresponding amount.

• Any interrupted or shortened stay (late arrival, early departure) due to the customer cannot give rise to a refund.

Cancellation by the Village of Cottages:
• In the event of cancellation by the Village of Cottages, except in cases of force majeure, the stay will be fully refunded. However, this cancellation cannot give rise to the payment of damages.

Cancellation by the Customer:
 Up to 30 working days before the start of the stay: Reimbursement of the deposit/instalments
 Less than 30 working days before the start of the stay: No refund of deposit/advances
 Less than 7 working days before the start of the stay: the entire stay is due

6) Stay at the Village of Cottages:

a) Arrival:

- On the day of arrival in the Village of Cottages, the customer will be welcomed from 4.30 p.m. Upon delivery of the rental keys, a deposit of €300 will be requested from the client.
- In case of late arrival, the installation procedure will be communicated to the customer by the Village of Cottages. Late arrivals are authorized only for customers who have already paid the balance of their stay and who have paid the deposit by bank card remotely.

b) During the stay:

- The customer is responsible for the surveillance of his personal objects (bicycles, etc.). The Village of Cottages declines all responsibility in the event of an incident relating to the customer's civil liability. All customers must comply with the provisions of the House Rules. Each tenant in title is responsible for the disturbances and nuisances caused by the people who stay with him or visit him.

c) Departure:

- On the day of departure indicated on the reservation, the rental accommodation must be vacated before 11 am.
- The accommodation must be returned in a perfect state of cleanliness, the inventory can be checked. Any broken or damaged object will be the responsibility of the customer, as well as the restoration of the premises if necessary.
- The deposit will be returned to the customer at the end of the stay or no later than 48 hours after departure, after deducting the compensation withheld, on supporting invoices, for any damage noted by the exit inventory. The withholding of the deposit does not exclude additional compensation in the event that the costs exceed the amount of the deposit.
- In the event that the accommodation has not been cleaned before departure, a cleaning fee worth 30 to 67 € including tax depending on the type of accommodation, will be requested from the customer and may be deducted from his deposit.
- For any delayed departure, an additional day at the current price of the night may be charged to the customer.

7) Animals:
- Animals are accepted, with the exception of 1st and 2nd category dogs, for a fee payable when booking. When allowed, they must be kept on a leash at all times and must not be left alone in the accommodations. They are prohibited around the swimming pools, in the relaxation/snack area. The vaccination record for dogs and cats must be up to date. Dog droppings must be picked up, animals must be walked outside the Village of Cottages.

8) Picture:
- You authorize The Village of Cottages, as well as any person that the Village of Cottages would like to replace, to photograph, record or film you during your stay on our site, and to use the said images, sounds, videos and recordings on all media (in particular on the Pole du Cheval et de l'Ane websites or Internet pages - including Facebook, Instagram, on the Village de Cottages, Pole du Cheval et de l'Ane presentation and promotional media, on the travel or tourism). This authorization is valid both for you and for the people staying with you. Its sole purpose is to ensure the promotion and animation of our establishment, and may in no way harm your reputation. This authorization is granted free of charge for a period of 5 years.

9) Dispute:
- Any possible complaint concerning the non-compliance of the services with the contractual commitments can be reported by post or e-mail to the Site Manager.

10) Mediation:
- In the context of a dispute, you can contact us as follows:

• Sending a letter by registered letter with acknowledgment of receipt to the Head of the Horse and Donkey Pole;
• Send a copy of this letter to SPL LES 1000 LIEUX DU BERRY – 6 RUE MAURICE ROY -18000 BOURGES.

11) Responsibility Cottage Village:
- The customer expressly acknowledges that the Village of Cottages – Pole du Cheval et de l'Ane cannot be held responsible for the communication by its partners or by any third party of false information which may be mentioned in the brochure or the Pole du Cheval et de l'Âne website concerning the reception sites, and in particular the presentation photos, the qualifiers, the activities, the leisure activities, the services and the dates of operation. All photos and texts used in the brochures and on the Internet pages are non-binding. They are indicative only. It may happen that certain activities and facilities offered by the Village, and indicated in the description in the brochure, are cancelled, in particular for climatic reasons or in the event of force majeure as defined by the French courts.

12) Computers and freedoms:

- The information that you communicate to us when placing your order will not be transmitted to any third party. This information will be considered by the Pôle du Cheval et de l'Ane as being confidential. They will be used only by the internal services of the SPL les 1000 lieux du Berry, for the processing of your order, to reinforce and personalize the communication and the offer of services reserved for customers according to your centers of interest.
- In accordance with the law Informatique et Libertés of January 6, 1978 amended in 2004, you have the right to access, rectify and oppose personal data concerning you.
