General terms and conditions of sale

1 - Preamble

The present terms and conditions govern the contractual relations relating to the sale of holidays between SARL LE LAC DES SAPINS and its Customers, in accordance with the provisions of articles L. 211-1 et seq. of the French Tourism Code. They regulate all the stages necessary for the booking and payment of holidays, and govern all follow-up between the contracting parties. Any document other than these general terms and conditions of sale, in particular brochures, advertisements and catalogues, is for information purposes only.

2 - Entirety

These general terms and conditions express the entirety of the obligations of the parties. The Customer is therefore deemed to accept them without reservation, in accordance with the provisions of article 1126 of the French Civil Code. These general terms and conditions for renting and booking holidays at Camping Le Lac des Sapins apply to the exclusion of all other conditions. They are accessible on the website www.camping-lacdessapins.com/ and will prevail, if necessary, over any other version or any other contradictory document. The Company SARL LE LAC DES SAPINS and the Customer agree that these general conditions exclusively govern their relationship. The Company SARL LE LAC DES SAPINS reserves the right to modify its general conditions from time to time. They will be applicable as soon as they are put on line. If a rental or holiday reservation condition is lacking, it will be considered to be governed by the practices in force in the campsite pitch rental sector.

3 - Capacity

The person making the reservation must be of legal age and legally capable of entering into the rental contract in accordance with these conditions and of guaranteeing the accuracy and veracity of the information provided.

4 - Purpose

The purpose of these general conditions is to define the rights and obligations of the parties in the context of the rental of camping pitches, rental accommodation or holidays offered by Camping Le Lac des Sapins to the customer, from the campsite's website, but also by telephone, by post or by e-mail.

5 - Pre-contractual information

The Customer acknowledges having been informed, prior to booking, of these general terms and conditions of sale, rental and stays, and of all the information listed in article L. 111-1 of the French Consumer Code. The Customer has access to all the information online or can have the services explained to them by telephone or electronically.

6 - Services and prices

Pitch hire

The Lac des Sapins campsite provides customers with a bare pitch for up to 6 people, for their tent, caravan or camper van. This is a fixed price per night of occupation for the type of pitch concerned. The basic package includes a pitch, 1 or 2 people and a vehicle. The Comfort package also includes an electric hook-up. Additional people (adults or children) or additional items on the pitch (second vehicle, pet, extra tent, etc.) are subject to an additional daily charge. The basic package gives free access to the sanitary facilities, reception, play areas and activities on offer, whether free or paying. For safety reasons, the number of people arriving for a stay may not exceed the capacity of the campsite pitch. Pitches are available from 2 p.m. on the day of arrival and must be vacated by 12 p.m. on the day of departure.

Rental accommodation

The description, definition of rental seasons, rental periods and price periods are given on the website. The price of rental accommodation includes rental of the accommodation, depending on the number of people (according to capacity), utilities (water, gas, electricity), a vehicle, access to reception services, play areas, other facilities and the activities on offer (free or paying). For safety reasons, the number of people arriving for a stay may not exceed the capacity of the accommodation. The fully-equipped accommodation must be left clean and tidy on departure. The accommodation is non-smoking. Rental accommodation is available from 4 p.m. on the day of arrival and must be vacated by 10 a.m. on the day of departure.

The rental of rental accommodation or camping pitches is by name only and may not be transferred or sublet.

7 - Price changes

Prices may change throughout the season. SARL LE LAC DES SAPINS may under no circumstances be held responsible for any difference in cost between two stays booked for the same period. The prices shown on the site are in euros, including VAT at the rate in force on the date of receipt of the deposit and the full price. Any change or modification of the rate as well as any change in the taxes applicable to the holiday, on the date of invoicing, may be passed on to the price of the holiday.

8 - VAT

Changes to the VAT rate in force will result in changes to the price of the holiday including all taxes.

9 - Special offers

Promotions are applicable at the time of booking. They cannot give rise to any claim or reimbursement after the event. Promotional offers are subject to certain conditions, in particular availability. In addition, price reductions or promotional offers cannot be combined unless otherwise stated. On these occasions, customers may have paid different prices for the same stay. Customers who have paid the highest price will not, under any circumstances, be entitled to a refund of the difference between the price they have paid and the promotional price.

10 - Tourist tax

The tourist tax collected on behalf of the Communauté de Commune Ouest Rhodanien and payable is not included in our prices. The amount per person and per day is determined each year by the COR.

11 - Booking and payment

BOOKING CONDITIONS

Customers may book online, by telephone or by post. All bookings must be accompanied by a payment including :

- 30% deposit

- Booking fees

- And any holiday cancellation and interruption insurance.

Regardless of the channel chosen, the booking only becomes effective once Camping Le Lac des Sapins has sent written confirmation of the booking by email (this confirmation can be sent by post on request) and once the deposit has been received, together with any booking fees and cancellation insurance.

BOOKING ON THE WEBSITE

For online bookings, for the order to be validated, the customer must accept these general terms and conditions by clicking where indicated and confirm payment. Once the booking has been made, the customer will receive an e-mail confirmation containing details of their holiday (content of services, dates and duration, price and payment terms).

Electronic signature applicable to online sales

The online provision of the Customer's bank card number and the final validation of the order will constitute proof of the Customer's agreement:

- payment of the sums due for the reservation,

- signature and express acceptance of all operations carried out.

If, during the online booking process, the Customer chooses another means of payment, the booking will only become effective once the confirmation sent by e-mail by the Campsite has been received and the payment has been cashed.

12 - Participants in the holiday

The number of tenants must be precisely in accordance with the accommodation capacity of the rentals and pitches. A complete list of participants (surname, first name and date of birth) must be given to reception by the day of arrival at the latest.

13 - Terms of payment

Payment for pitches

The balance must be paid on the day of arrival after recalculation of the effective stay. If you have taken out cancellation insurance, the balance must be paid 10 days before the day of arrival.

Payment for rental accommodation

The balance of the stay must be received by the campsite no later than 10 days before the date of arrival (holiday vouchers are sent by recorded delivery with acknowledgement of receipt). After this deadline, if the balance has not been paid in full, we will consider your rental as cancelled and will retain the sums already paid.

Please note that VACAF cheques are not accepted.

Last-minute bookings

All bookings made less than 10 days before the arrival date must be paid in full. The reservation will only be effective on receipt of payment and provided that the holiday is still available.

14 - No right of withdrawal

In accordance with article L. 221-28 12° of the French Consumer Code, the right of withdrawal does not apply to accommodation, transport, catering and leisure services provided on a specific date or at a specific time.

15 - Method of payment

Camping Le Lac des Sapins accepts the following methods of payment:

For payment of the deposit: bank card (the cards accepted are those of the Cartes Bleues, VISA, Mastercard and Maestro networks), bank cheques, holiday vouchers (to be sent by registered post).

For payment of the balance: bank card (the cards accepted are those from the Cartes Bleues, VISA, Mastercard and Maestro networks), bank cheques, holiday vouchers (sent by recorded delivery by post), and cash in Euros delivered in person to the campsite reception.

16 - Allocation of pitches

Pitches are allocated without distinction and in order of registration in order to optimise planning. The management of Camping Le Lac des Sapins can under no circumstances guarantee that the pitch requested by the customer will be allocated.

17 - Change of stay

The customer may request a change to their stay no later than 60 days before their arrival date (change of date and/or type of accommodation) by written request to the campsite (by post only) subject to availability. No postponements will be accepted for the following season. Customers should note that in the event of a change to their stay, they will not be able to benefit from any promotions subsequent to their initial reservation, as the date of the first reservation will apply. In the absence of a modification, the customer will have to make his stay under the initial booking conditions or cancel it in accordance with the cancellation insurance conditions.

Any request to increase the length of your stay will be subject to availability and the current rates.

Any request to reduce the length of your stay is considered as a partial cancellation and will be subject to the cancellation and interruption of stay conditions.

In the absence of notification by e-mail or letter from you indicating a postponement of your arrival date, the accommodation may be available for sale again from 2 p.m. on the day after your scheduled arrival and you will consequently lose the benefit of your reservation. Pitches may be reopened for sale from 8pm on the day of arrival.

18 - Cancellation of stay

Cancellation by Camping Lac des Sapins :

In the event of cancellation by Camping Lac des Sapins, except in cases of force majeure, the stay will be refunded in full (the booking fee and the cancellation insurance payment will be retained). However, this cancellation cannot give rise to the payment of damages.

Cancellation (total or partial) by the Customer:

The Customer must notify Camping Lac des Sapins by sending a letter by recorded delivery with acknowledgement of receipt to the following address: CAMPING LAC DES SAPINS - RUE DU STADE - 69550 CUBLIZE. The date of receipt of the cancellation will determine any cancellation charges. Failing this, the customer will be liable for payment of the sums due under the contract. Whatever the date of cancellation, the booking fee and any insurance taken out are non-refundable.

No refunds will be made unless cancellation insurance has been taken out, and in accordance with the terms and conditions of the latter (see Cancellation insurance paragraph).

If cancellation occurs :

More than 10 days before the start of the holiday: the booking fee will be retained.

Less than 10 days before the start of the holiday: 100% of the cost of the holiday will be charged and no refund will be given.

NON-CHANGEABLE, NON-CANCELLABLE, NON-REFUNDABLE RATES (GOOD DEAL RATE)

Camping Le Lac des Sapins may offer stays and rentals at rates that cannot be changed, cancelled, refunded or exchanged (Good Deal rate). The cancellation and modification conditions set out above do not apply. Consequently, no refund will be made, including the refund of any ancillary services booked. No reason whatsoever will give rise to a refund from SARL LE LAC DES SAPINS.

19 - Holiday cancellation and interruption insurance

Holiday cancellation and interruption insurance is optional, but the Customer is invited to take out this insurance when booking. The amount is a percentage of the total cost of the holiday (5%). This insurance covers cancellations in the event of illness (hospitalisation), serious accident or death, accidents causing major damage to your home, redundancy or changes to your holiday as a result of your employer, or because you have been called to an examination or to court. The full terms of the cancellation insurance contract are available on request and on our website. In the event of cancellation or interruption of your holiday, for a reason falling within the scope of the contract taken out, you must declare your claim by Internet: www.declare.fr or by e-mail: sinistres.affinity@gritchen.fr or by post to : Gritchen Tolède Associés - Service Claims - 27 rue Charles Durand - CS 710139 - 18021 BOURGES Cedex.

20 - Late arrival, early departure

In the absence of a message from the Customer acknowledging receipt, specifying that he/she has had to postpone the date of arrival, the pitch will become available from 8pm on the same day, the accommodation will become available from 2pm on the following day, and full payment for services will still be required. No reduction will be granted in the case of early departure for rental accommodation (see refund possibilities under the cancellation insurance).

21 - Deposit

For all rental stays, a deposit of €380 will be required, at the latest on check-in, by credit card (cheques and cash are not permitted). This deposit will be returned in full on the day of departure or within eight days at the latest, after a housekeeping check and satisfactory condition of the equipment. If this is not the case, the deposit will be deducted in part or in full. Any damage exceeding the amount of the deposit will be charged to the customer.

22 - Cleaning

Customers must return their accommodation in a perfectly clean condition. We offer a CLEANING option, which means that you do not have to clean your accommodation on departure. The price of this service is indicated in our option price list.

23 - Leisure activities

Any free or paying activity mentioned on our website, in an email or offered on site may, in certain circumstances, be modified or cancelled on your arrival on site.

24 - Minors

Minors who are not accompanied by their parents are not accepted.

25 - Pets

The Campsite's agreement is required for all animals. The management reserves the right not to accept a stay if it has not been notified in advance and has not given its agreement.

In all cases, a maximum of two pets may be accepted per accommodation or pitch, subject to payment of a daily fee. Pets are not allowed to roam freely and must be kept on a lead. They are not allowed in the public areas (hall, snack bar, tennis court). Two conditions must be met for pets to be accepted: - valid anti-rabies vaccination - identification by tattoo or chip certified by a card issued by the Société Centrale Canine. Customers must bring their pet's health record with them and comply with the internal rules of each site. Dangerous or aggressive animals (1st and 2nd category dogs prohibited) as well as new pets are not accepted.

26 - Visitors

Visitors (i.e. people who are not customers of Camping Lac des Sapins and who come to visit customers of Camping Lac des Sapins) are strictly forbidden.

27 - House rules

In order to facilitate the stay of all our customers, a set of house rules is available at reception. It is imperative that you read them and respect them. In the event of non-compliance with these rules, the campsite management may impose sanctions, including termination of the contract.

28 - Liability insurance

Liability insurance is compulsory. It is the Customer's responsibility to take out insurance to cover any damage he/she may cause to the campsite or rental accommodation and to his/her belongings, suitcases, valuables and vehicles.

29 - Loss, theft and damage

The Camping Lac des Sapins declines all responsibility in the event of theft of or damage to personal items both in the accommodation and in the communal areas. Camping Lac des Sapins may not be held responsible in the event of theft or damage to customers' personal belongings, except in the event of a proven breach by the campsite of its contractual obligations. You are also reminded that the car park is not guarded and that parking is therefore at your own risk. Camping Lac des Sapins also declines all responsibility in the event of an incident for which the Customer is liable.

30 - Personal data

Customers' personal data is collected and processed by the Company SARL LE LAC DES SAPINS. Certain data is essential for managing the booking of the Customer's holiday and will also be used to send the Customer information and/or promotional offers. In accordance with article 40 of the French Data Protection Act no. 78-17 of 6 January 1978, the Customer has the right to access, modify, rectify and delete personal data concerning him or her. 31 - Photos and image rights

The photos in brochures, websites and any other communication media are not contractually binding.

You expressly authorise SARL LE LAC DES SAPINS, without compensation, to use any photos of you or your children that may be taken during your stay for advertising purposes.

32 - Force majeure

Any circumstances beyond the control of the parties that prevent the performance of their obligations under normal conditions are considered to be grounds for exoneration from the obligations of the parties and lead to their suspension. The party invoking the circumstances referred to above must immediately notify the other party of their occurrence, as well as of their disappearance. Force majeure means any irresistible event or circumstance that is external to the parties, unforeseeable, unavoidable, beyond the control of the parties and that cannot be prevented by the parties, despite all reasonable efforts. The following are expressly considered to be cases of force majeure or fortuitous events, in addition to those usually accepted by the case law of French courts and tribunals: storms, floods, lightning, earthquakes, fires, stoppage of telecommunication networks or difficulties specific to telecommunication networks external to customers, blockage of means of transport or supply. The parties will meet to examine the impact of the event and agree the conditions under which performance of the contract will continue. If the force majeure event lasts for more than three weeks, the pitch rental and accommodation contracts will be terminated automatically.

33 - Partial non-validation

If one or more stipulations of these general terms and conditions are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain all their force and scope.

34 - Non-waiver

The fact that one of the parties does not take advantage of a breach by the other party of any of the obligations referred to in these general terms and conditions may not be interpreted for the future as a waiver of the obligation in question.

35 - Language of the contract

These general terms and conditions of sale are drawn up in French. If they are translated into one or more foreign languages, only the French text will be deemed authentic in the event of a dispute.

36 - Mediation

In the event of a dispute arising concerning the validity, interpretation, performance or non-performance, modification or cancellation of the contract, the Customer and Camping Lac des Sapins will endeavour to find an amicable solution. To this end, the Customer must send his complaint by registered post with acknowledgement of receipt to CAMPING LAC DES SAPINS - 968 RUE DU STADE - 69550 CUBLIZE within one month of the holiday. If the Customer or Camping Lac des Sapins consider that a complaint made under the above conditions has not been satisfactorily resolved, the most diligent party must submit the dispute to CM2C, an association (law 1901) with a network of mediators. For the customer's full information, it should be noted that recourse to CM2C is a free procedure, even if the customer initiates the referral. To find out more about CM2C: www.cm2c.net If mediation fails, the Customer and CAMPING LAC DES SAPINS may refer the matter to the competent French court.

37 - Applicable law

These general terms and conditions are subject to French law. This applies to both substantive and formal rules. In the event of a dispute or claim, the Customer must first contact Camping Lac des Sapins to obtain an amicable solution.
