CAMPING SITE HOF BIGGEN

1. Conclusion of the guest accommodation contract

1.1. The basis of the host's offer and the guest's booking are the description of the accommodation and the additional information in the booking basis (e.g. location description, classification explanation) insofar as these are available to the guest at the time of booking.

1.2. The host points out that according to the legal provisions (Section 312g Paragraph 2 Sentence 1 Item 9 BGB) there is no right of cancellation for guest accommodation contracts that were concluded via distance selling (letters, catalogs, telephone calls, telecopies, emails, messages sent via mobile phone service (SMS) as well as radio and telemedia), but only the legal regulations on the non-use of rental services (Section 537 BGB) apply (see also Item 3 of these guest accommodation conditions). However, a right of withdrawal exists if the accommodation contract was concluded outside of business premises, unless the oral negotiations on which the conclusion of the contract was based were conducted at the consumer's prior request; in the latter case, there is also no right of withdrawal.

1.3. By pressing the button book with payment the guest makes a binding offer to the host to conclude the accommodation contract. The guest will immediately receive electronic confirmation of receipt of their booking.

1.4. The transmission of the contract offer by pressing the button book with payment does not give the guest any right to the conclusion of a accommodation contract in accordance with their booking details. Rather, the host is free to decide whether or not to accept the guest's contract offer. The contract is concluded when the guest receives the booking confirmation from the host.

1.5. If the booking is confirmed immediately after the guest has made the booking by pressing the button book with payment by means of a corresponding display on the screen (booking in real time), the accommodation contract is concluded when the guest receives and displays this booking confirmation on the screen, without the need for an interim notification of receipt of their booking. In this case, the guest is offered the option of saving and printing the booking confirmation. However, the binding nature of the guest accommodation contract does not depend on the guest using these options for saving or printing.

2. Arrival and departure

2.1. Unless otherwise expressly agreed in individual cases, the pitch cannot be occupied before 3:00 p.m. and the guest must arrive by 6:00 p.m. at the latest.

2.2. The following applies to later arrivals: a) The guest is obliged to inform the host by 6:00 p.m. at the latest or at the agreed arrival time if he or she is arriving late or does not want to move into the booked pitch until a subsequent day in the case of stays lasting several days. b) If notification is not made on time, the host is entitled to occupy the pitch for someone else. For the period of non-occupancy, the provisions on cancellation or non-arrival of the guest in these guest accommodation conditions apply accordingly. c) For periods of occupancy in which the guest does not use the pitch due to late arrival, the provisions on cancellation or non-arrival of the guest in these guest accommodation conditions apply accordingly. The guest does not have to make any payments to the host for such periods of occupancy if the host is contractually or legally liable for the reasons for the late arrival or non-occupancy.

2.3. The guest's pitch must be vacated at the agreed time, without special agreement, by 12:00 noon on the day of departure at the latest. If the pitch is not vacated on time, the host can demand additional compensation. The host reserves the right to assert further damages. The guest is only entitled to use the accommodation's facilities after 12:00 noon on the day of departure if the host has given general notice to this effect or if an agreement has been made with the host in individual cases.

3. Cancellation and non-arrival

3.1. A cancellation or a non-arrival without a declaration of cancellation is only free of charge for the guest if the host has granted the possibility of a free cancellation in the form of a general notice or a special agreement and the declaration of cancellation is received by the host within the specified period.

3.2. In the event of cancellation or non-arrival by the guest without a declaration of cancellation, the host remains entitled to payment of the agreed price of the stay, including the portion for meals and the fees for Additional services exist.

3.3. The host must, as part of his normal business operations, endeavour to find an alternative use for the accommodation, without being obliged to make any special efforts and taking into account the special nature of the booked pitch (e.g. location).

3.4. The host must allow alternative occupancy and, if this is not possible, saved expenses to be taken into account.

3.5. According to the percentages recognised by case law for calculating saved expenses, the guest must pay the host the following amounts, each based on the total price of the accommodation services (including all additional costs), but without taking into account any visitor's tax: For holiday apartments/accommodation/pitches without meals, 90% of the travel price.

3.6. The guest expressly reserves the right to prove to the host that his saved expenses are significantly higher than the deductions taken into account above, or that the accommodation services have been used for another purpose. In the case of such proof, the guest is only obliged to pay the correspondingly lower amount.

3.7. Taking out travel cancellation insurance is strongly recommended.

3.8. In the case of direct bookings with the host, the declaration of cancellation must be sent exclusively to the host, not to local tourism offices or other agents, and must be made in writing.

4. Payment

4.1. After the contract has been concluded (receipt of the booking confirmation or acceptance of a binding offer), the host can request a deposit of up to 20% of the total price of the stay.

4.2. The entire price of the stay, including all additional costs, is due to be paid to the host on the day of departure, unless otherwise agreed.

4.3. For stays of more than one week, the host can prepare an interim invoice, which is due for payment immediately.

4.4. Unless otherwise expressly stated or agreed in individual cases, payments can be made in cash or by debit card. Payments cannot be made in foreign currencies.

4.5. If the guest does not make an agreed down payment or does not make it in full despite a reminder from the host setting a deadline, the host is entitled, provided that he is willing and able to provide the contractual services himself and provided that the guest has no legal or contractual right of retention, to withdraw from the contract with the guest and to charge the guest with cancellation costs in accordance with section 3 of these terms and conditions.

5.Limitation of liability

5.1. The host's liability under the guest accommodation contract according to Section 536a of the German Civil Code for damages that do not result from injury to life, body or health is excluded unless they are based on an intentional or grossly negligent breach of duty by the host or a legal representative or vicarious agent of the host.

5.2. The host is not liable for service disruptions in connection with services that are recognizably only arranged as third-party services for the guest during the stay (e.g. sporting events, theater visits, exhibitions, etc.). The same applies to third-party services that are already arranged together with the booking of the accommodation, provided that these are expressly marked as third-party services in the advertisement or the booking confirmation.

6. Guest's obligations; bringing pets

6.1. The guest is obliged to observe any house rules or yard rules that have been communicated to him or for which there was a reasonable possibility of becoming aware based on appropriate information.

6.2. The guest is obliged to report any defects and disruptions to the host immediately and to demand remedial action. If the defect is negligently not reported, the guest's claims may be completely or partially void.

6.3. The guest can only terminate the contract in the event of significant defects or disruptions. He must first set the host a reasonable deadline for remedying the defect as part of the defect notification, unless the remedy is impossible, is refused by the host or the immediate termination is objectively justified by a special interest of the guest that is recognizable to the host or for such reasons it is objectively unreasonable for the guest to continue the stay. 6.4. Bringing and keeping pets in the accommodation is only permitted in the case of an express agreement to this effect, if the host provides for this possibility in the advertisement. Within the framework of such agreements, the guest is obliged to provide truthful information about the type and size of the pet. Violations of this may entitle the host to terminate the guest accommodation contract without notice.

7. Choice of law and place of jurisdiction

7.1. The contractual relationship between the guest and the host is subject exclusively to German law. The same applies to the other legal relationship.

7.2. The guest can only sue the host at their registered office.

7.3. For lawsuits brought by the host against the guest, the guest's place of residence is decisive. For lawsuits against guests who are merchants, legal entities under public or private law or persons who have their place of residence/business or habitual abode abroad, or whose place of residence/business or habitual abode is not known at the time the lawsuit is filed, the place of jurisdiction is agreed to be the host's registered office.

7.4. The above provisions on the choice of law and the place of jurisdiction do not apply if and to the extent that non-negotiable provisions of the European Union or other international provisions applicable to the contract are applicable.
